When they Prosecuted me (Sgt.Phil Tyson & West Yorkshire police) as i have said...
They did not put the offence through correctly as "Flyering" which has its own seperate offence, and is in fact a fine.
Issued by the Council, not a criminal Court charge..
Also in that offence, even painting a wall, using paste and posters is given specific mention.
But Political, religious and charity posters, pasted flyers and even paintings are exempted from the charge/fine.
Anyway, i think it was because i challenged Alan White about his stealing by notices (depriving me of them) which was the reason why they wanted to bundle it all together to get me arrested and send me to court, even though i had right to public speaking to Alan White to challenge him over the theft of my notices when the Bradford Council had given written consent in writing by email. (even though i didnt need consent, but i had made effort to ask and also i had written to the Chief Police officer Dee Collins to state my intent who did not care to respond over the matter.
Anyway...
I think they processed the charges incorrectly... as the REASON WHY it comes under flyering and NOT CRIMINAL DAMAGE.. is BECAUSE when petitioning its NOT CRIMINAL DAMAGE as you have the RIGHT.
And this is clearly STATED in the CRIMINAL DAMAGE LEGISLATION ANYWAY!!
So I dont know how the CPS OVERLOOKED THIS?!
And Police, unless they just IGNORED IT ON PURPOSE?
But Going by my Manchester Salford COURT Appearance....
I would say that the DUTY SOLICITOR was "Stupid" and "UNEDUCATED" TOTALLY on the Matter.
And the LEWGAL ADVISOR and MAGISTRATES completely and totally UNEDUCATED or ALOOF.. or just Malicious.
I deffinately think the Duty Solicitor was unknowledgable and untrained in this subject.
There is deffinately account here when a "Right applies"
And the "Right to petition" is a perfect example of one right that applies.
So, i was not wrong and am not wrong.
In fact it is not just "A Lawfull excuse" after all. it comes in under "THE RIGHT"..
equal to that of the Local Authority..
Thus i can use anything which the local Council does, Signs, Paint, Stickers, Paste, Plastic tags. Whatever is appropriate for the attachment and duration. Metal sign clamps..... wall paint even.
The right is created by a Bill. "The Bill of Rights".
And is most deffinately applies as in the clean neighbourhoods and environment act 2005 Political purposes (and charity and religious) are included, also if its non commercial as well. such as a letter delivered, a document or legal notice to or on a property that might cause damage, such as a parking ticket sticker.
