Refusing service
www.business.gov.au/info/plan-and-start/start-your-business/what-is-customer-service/refusing-serviceOk so The Sun newspaper refused service to me and wouldnt publish my petition notice.
They refunded the money. And because they did... The ombudsman is saying or trying to claim tgat he cannot do anything. As are trading standards. This is not the case.
Also the Advert appeared in both the Daily Mail and London Evening Standard. And they confirmed that there is no legal reason why the advert cannot be published.
The Sun first gave the "Legal excuse" which was a lie. The trading standards and consumer and press ombusdman do not think a lie is bad or a breech of conduct and behaviour. Even though that is the entire problem that society is an and these lies are what are causing the culmative damage to the council police and courts as well as press standards. But unless iys shouting swearing or screaming.. The ombudsman doesnt want to know. Even if crime is involved and any offences. Such as fraud by false account giving or failure to reveal information when there is a legal obligation to do so.
Anyway...
The Sun... After i challenged their lie and excuse over the legal reason not to publish... Then just made up another reason. Which was essentially... "They dont want to" publish it.
But... Even though they have refused my advert fot the petition AND refunded my money back...
They have now sent 3 more invoices out. All from 3 of their different offices!
I had sorted it out with their peterborough office accounts.
Now 2 days in a row... 2 more letters saying that i owe them money.
But they have agreed by telephone that i dont owe it and have confirmed the refund as have the bank.
Apparently i could pay the money again. THEN complain to the ombudsman that they have to provide the service.
But i am still certain that the refusal of service terms are the same for UK, US and Australia.
If you see the link... It says you cannot be refused for age, gender, race or religion. And i am certain that includes your political alignment as well... Say you cannot be refused service just because you are a labour voter or conservative voter. Because ballots and voting and "petitions" cannot be prosecuted against and its exempted from Advertising standards as well as part of your civil rights and human rights.
If you check the link.. There is also something in there about a service provider not being allowed to refuse service on those terms where they would be able to 'disadvantage' you.
So... If you were selling garden ornaments. And the SUN refused to place an advert for your garden ornaments because they were already doing another garden ornament advert for someone else... That would be a breech. Because they are allowing ornaments in a near identical advert to give advantage to one trader. While refusing yours. Thus a breech.
Dragond den do that a lot. Oh we cannot dova deal for telephones with you because we already have a deal withva telephone buisness. Well. In fact that is a breech IMHO because its disadvantage to one person.
Often overlooked in many trades circles.
An abused reason not to supply.
Anyway...
If say the garden ornaments were of a male genital it could be reason to refuse service. Or if the ornaments were too expensive or poor quality. Or say sinister.
But if they were to be sold to sponsor a political exempt campaign say against lung cancer and had messy grotesque organs or gory blood to put someone off smoking.. Then it would be exempt IF for political and possibly charitable or religious purpose.
Anyway...
So... Because its a petition and exempted and i am using free speech and humsn right asking for the vote and ballot signature of the public for my political cause... Really the newspaper cannot refuse. Its the public who can either choose to sign or not to sign the petition. The newspaper cannot obstruct it or refuse service to effect or disadvantage the petition. Especially if they have been running other peoples petitions.. Like the 38 degrees website.
A labour friend of a friend of the newspaper chief editor cannot say to his pal.. Or MP colleagues or aquaintances canmot say to the newspaper... Dont publish that petition because we are opposed to it.
Labour dont pull down conservative flyers and notices. Or stop them running adverts. Its kust not done. Not good sport. In fact they cannot stop the placement of the notices as thats the entire point they are exempted.
The problem is.. If you are not a political party... And are doing a petition by yourself on a controversial subject... Such as speed cameras.. Then the government are likely to not like it. But they know that you can lawfully do it. Thus any obstruction.. Like refusal of newspapers or other hack or BBC social hack via the TV or Radio... The government and Co. Are not going to want to be directly accountable for the social or buisness originated obstruction.
Thus... Either the SUN newspapers legal team are either retarded or else have personal or political reasons to refuse you service. And it IS a breech to disadvantage a persons political freedom and right to request signatures from the public on any matter that that they choose. Without any other petition being given the advantage over them.
That is democracy.
So... As well as The Sun causing my plans for the petition publish date to go wrong and now with all these bills being sent when they have refunded me and refused the advert on no grounds at all. I think that i should get the advert published. And get ot published for free.. To compensate for all the trouble and hassle. Plus why are they still sending bills?
Also, the ombudsman CAN have them investigated for lying under conduct and behaviour. Same as thw magistrates ombudsman with lies as well.. All that have caused all these road signs problems in the first place. Which is more damage than any single shouting or swearing breech. And IS conduct. Just like the illegal prosecutions against me. Which actually is crime.
Anyway... Mabe its best i dont bother with the Sun anyway.. As i didnt really get any signatures from the Daily Mail or London Evening Standard adverts. Even though i did get a lot more visitors reading the website.
