Bolton Red light camera., incorrect stop line width & other things. Compare to Macclesfield.

So... I have mentioned this subject before..

The Square of Death, traffic light camera by the Bolton Wanderers stadium.

I did get done by this camera several years ago which was a very traumatic experience in court.
I did get special reasons not to be convicted, because I had gathered evidence of the Square of death.

But I used Freemans and Co solicitors of Manchester because I had listened to Mr Loophole himself on the BBC Jeremy Vine show. Talking about road signs being wrong.

Freeman was presented as a "Martin Lewis" of road traffic. And as Money saving expert has helped me recover £2,000 taken by the Bank, I thought Mr Freeman was similar but for road traffic traps used on us.

When I got caught out by the Bolton traffic lights, Freeman solicitors said it would be £4,000 for the defence. But ad he is the best in the country... And I was looking at loosing my driving licence and vocational job and very worried... Work helped me with the money.

I sent Freemans the basic research of the traffic lights.

But Freeman did not show up. It was a girl Barrister who "just worked at the Bolton court". She didn't introduce herself or even ask who I was.

There was no Freeman with magic loopholes defence or even strong defence with my evidence. But the trauma and money seemed to win over the magistrates, although the legal advisor did try to help me as best he could with his limited knowledge.

So..... As I was got off on "Special reasons" not to endorse my driving licence. So got no points. But I still had to pay court costs and as I was still guilty I could not claim the money back.

Now, the traffic light camera is run by Greater Manchester police. Not Lancashire police. And has the Green bike lane markings that are un_uniformly used around Manchester and surrounding areas.

I have, re visited the site today, to evaluate it again, after gaining some knowledge surveying the Macclesfield traffic lights over the recent 12 months

And I have found that the Square of Death traffic lights at Bolton have incorrect road markings and the traffic regulation order was not enforceable. Thus I should be able to reclaim the £4,000 Freeman & Co fee from the Court/police

So... It seems like this road safety support place is going to be very significant...

I've looked into litigation and "expert witnesses" play a major role for both sides.

So I am interested what expert witnesses have been used in all these accident claim cases of tripping on pavements and such?

Because it does not seem like similar cases have been made for incorrect markings at traffic lights or speed cameras. Only defence.

Thus it appears that with only a small pool of fixed cameras, the solicitors, or expert witnesses seem to not want to challenge the fixed traffic light and speed cameras. But instead concentrate on "accidents" of impact.

Not accidents of contravention of traffic regulations orders by bring mislead by incorrect signs or markings . Not those kind of slip ups.

It seems choice and path of legal process selection is controlled by the major players in the game. Not by the clients? (unless their client is the police & cps)

Here are some interesting facts that appear when you start to research Litigation against the council.. the people who step in to "help out the police" block your speeding & traffic light defence start to show up.

Do they do uneven curbstone examinations as well for trips & falls? plenty more trips & falls than traffic light cameras to set straight once & for all, eh?

So, here is a petition website of Manchester City council. They are facilitating the petition process for matters that concern the Manchester area.

Manchester City Council - How will the Council deal with my petition?

Manchester City Council welcomes petitions and recognises that they are just one of many ways in which people can let us know about their concerns and participate in the democratic process. The guidance below summarises the Council’s petitions scheme and applies to all petitions submitted that fall within the scheme.

They set out their own "preferred" terms & conditions and what they state they would like to accept and what they will want to reject.

This obviously is not the absolute law, its just as they choose to present their own petitions service that they have put together.

Obviously if you do your own petition it is subject to nothing but the Law. But i guess Manchester Council is not "HM Government" ? or is it?

Is a Local authority the local branch of HM Government?

Anyway.. interestingly they state that they dont want to accept any petitions over and Legal action that has been taken.

These are really interesting listings of things the council really doesnt want you to petition about.. and interestingly the list is pretty much everything you would want to petition about that was important! (in law you can petition about anything)

I mean just look at the Monster Raving loony party genuine policy list if you want to get serious)

3.1 The majority of petitions we receive will be accepted but there are some circumstances where we will not be able to deal with your petition under this scheme. Petitions that fall outside of this scheme include:
 Are there any petitions that the Council cannot accept? Any matter that the Council is not directly responsible for or has no influence over. We will return the petition to you and where possible direct you to the correct organisation.
 Any matter relating to a planning decision – These will be dealt with using existing procedures. For further information about making representations about planning decisions, please contact the planning team at planning@manchester.gov.uk
 Any matter relating to a licensing application – These will be dealt with using existing procedures. For further information about making representations, please contact the licensing team at licensing@manchester.gov.uk
 A statutory petition (for example a petition for a directly elected mayor)

So basically, A petition is something that gives a Citizen and the "people" power to get together to challenge the Government over any matter that is important to them... And that is the most strongest power you will ever have. It is Democracy.

1.5 Petitions should be relevant to a matter over which the Council has powers or duties. You can refer to the Council’s constitution at www.manchester.gov.uk/downloads/download/4030/the_constitition or contact the Governance and Scrutiny Support Unit if you need further advice. If the petition does not fall within the remit of the Council’s powers, we will return your petition to you and where possible, try to identify the correct organisation for you to send the petition to.

So these from the list are interesting...

Well... there is nothing in the Law that says you cannot petition against those causes.. inclusive of..

Now, if we think of this as a "court" making a legal decision whom are not "the council" that may give a plausable excuse to get the council "out" of having to accept a petition or act. OR them saying that it is "The Police" not THEM you should be Petitioning.

BUT if we Take the Wharfedale Observer example again here>

And The Rawdon Fine refunds.. it most certainly WAS the Council who acted to badger the police to refund the drivers fines when the traffic regulation order was incorrect.. er.. not in place!

So... If we could bring Attention to the M60 controversial 50mph speed limit at Breadbury that has Illegal size 1500mm terminal signs that are reserved for road works only. And the Fact that according to the Traffic Signs Manual you do NOT have 50mph Motorways at all.. and that there are numerous examples of Similar roads that are NOT 50mph... it is evident that the Highways & council are NOT providing CONSISTENT and expedient transport at all, of which is required of them. ALSO the M60 is the same bend both ways, but the 50mph speed limit is only in place ONE way around. It was listed as the highest Grossing speed camera at one time in a National Tabloid story.

THUS because INCORRECT & ILLEGAL road signage is ON PAR with a incorrect or not placed Traffic regulation order, which is required for enforcement of the speed limit...

There is NO REASON why Manchester City Council can not be petitioned to get Greater Manchester Police to refund the Fines to all the Drivers on the M60, because the Road signage does NOT comply with the Road Signs Manual thus the Highways authority and police have not met their obligations for the evidence obtained from the road to be viable for prosecution material.

A very important matter that the council should not be trying to evade. And that would include the numerous "Bus Lane Fine" issues around the city which have highly questionable Layouts as well and can be misleading to drivers. (I actually investigated one of these bus lane traps myself after being caught out by it)

So.... I do believe that drawing up a petition about the M60 Motorway 50mph limit & fine refunds IS viable to submit to Manchester city council.

And as there is some controvery over the "MANCHESTER" area Traffic light "MIX N MATCH" Green cycle lane confusion spanning from The Bolton Wanderers stadium all the way to near Stockport.. and around.. that is confusing, misleading and a jumble to any consistency or uniformity... then i do believe that the traffic light cameras are open to petitioning as well.

In fact my Own HM Government petitions about speed fines & cameras previously were both accepted as well as my new petition. So Machester City council are just being extremely "biased" about what they want and dont want to accept as petition material.
