The main thing which is allowing professional negligence to be rife & go un-controlled and grow.. Particularly in Magistrates Courts is the LACK of a (Recorded) sessions requirement.
If Magistrates Courts hearings & trials were all RECORDED..
Then not only would magistrates be held to greater account for their actions, words, conduct & professional negligence... also Legal advisors as well for failure to act and apply the law and intervene.
Also.. the presentations and case work given before a court is often a complete shadow and underachievement of what is "proposes to be" and what is (costed) out beforehand by the Solicitors...
They profess to extensive research, costs and services.. which when the truth is disclosed amount to severely LESS than what has been paid for and expected.
thousands of pounds of fees for expensive £1500 defences.. end up being less than half an hour of discussion in a room, which seem to be completely lacking from the barrister/solicitor on the day of the court date.. and instead a 5 minute chat is scribbled down on paper notes which could have been something a duty solicitor could have done for free.
It is in a lot of cases an absolute shambles.
I believe that gathering evidence of this, could uncover a need for radical changes to the Justice system.
Court Staff, legal advisors & District Judges, also act & behave more like "The Adams Family" or "a retirement home" rather than a professional legal unit.
The Restriction on what can be said, heard and voiced.. is an absolute BARRIER to "The Truth, the whole truth & nothing but the truth"
Rather than any real facilitation of finding out "anything" at all.
Literally the Modern Magistrates Prosecution case presentation is not much more than the standard of some middle school teachers in a History or English class. Or even a First School.
More intelligence and detail is used in a college art class.
People are being given fines, having to pay THOUSANDS in court fees and fines and even very serious sentences and driving disqualifications which are serious matters..
And much more details and information could be given earlier than the way it is currently set up.. And with the type of people currently working in these organisations.
It is a huge short coming & failing of Government..
And to find over 5 Major Road Traffic sites unlawfully signed of the speed limits.. only highlights the tip of the iceberg of more serious problems in courts, in the prosecution & with the police themselves.
Its like the Magistrates Court is a (Catch all) net and only the crown court is the professional court..
But even then.. there are questions as to why fees are so high when the standard of work is so poor.
